Abstract

Our Review joins the celebration of the Constitution’s silver wedding with these reflections from one of our most frequent collaborators. Here, certain key questions are successively touched on and assessed, according to the text of the constitution itself. Basic rights have been guaranteed, from a generous interpretation of fundamental rights. The system of democratic representation suffers certain defects that lead to a lack of quality in our democratic life. The parliamentary system is prone to an excessive presidential stamp and predominance of the government. Judicial power, with excessively politicised governing boards, still needs to undergo a process of modernisation. Reform of the Administration is still awaited. And, above all, a turnaround in authority has happened in favour of setting up the novelty of a State of Autonomies – still subject to virulent controversy. The question is still open regards the possible reform of our fundamental charter.
