Southern Border: a political and legal reality “constructed” which generates Human Rights violations

Abstract
Policies and normative tools that are been applied in the border control and management of migratory flows on the Southern Border don’t correspond with the reality of these phenomena. That situation contradicts their stated goals (preventing human trafficking, encouraging regular migration, fighting international terrorism...) and it is causing serious human rights violations against migrants as “collateral damage”. In this article we analyze main political–legal contradictions associated with the process of outsourcing border control driven by the EU and Spain. Besides, we pay attention to the perversion that represents conditioning the development cooperation to the control of migratory flows, and the questioning of the Rule of Law linked to the arbitrary expellings (and other similar practices) carried out at the Spanish and European borders.
