Abstract

It poses, in this study, from an essentially juridical perspective, the incidence of the laicism (laity) in the Spanish legislation. The question tackles from a triple perspective: the law compared, the historical law Spanish and the jurisprudence of the Spanish Constitutional Court. From this perspective analyse the relations that the State has to be supported by the religious Confessions, inside the norms of the Spanish Constitution. The most notable conclusion of the same is that the Spanish Constitution designs a State-freedom, when assuming the freedom like a principle and a fundamental value of the legislation; and no a secular State, as the laicism (laity) only would appear as simple half to guarantee the value freedom.
